Definitions

(a)           Quest Energy means Quest Electrical and Solar Pty Ltd trading as Quest Energy, ABN 44 608 159 762

(b)           Customer means Person/s to whom this quote is addressed.

(c)           Goods means the products/system set out in the Solar PV Acceptance Form in this quote.

(d)           Price means the total amount payable by the Customer to Quest Energy for the Goods as set out in this quote, comprising the deposit and balance amount.

 

 1. Agreement

1.1 The agreement between the Customer and Quest Energy is for the installation, supply and purchase of the Goods and is comprised of these terms and conditions and the quote.

1.2 A written quote is valid for 1 week from the time of issue and is subject to a site inspection by Quest Energy.

1.3 Acceptance of this written quote constitutes a contract of sale between the Customer and Quest Energy. Acceptance shall be deemed to have occurred upon the Customer signing the quote.

1.4 If there are unforeseen conditions at the Customer’s site which require a substantial change to the quoted installation of the Goods, Quest Energy or the Customer may immediately terminate this agreement in writing. Quest Energy will refund all amounts paid by the Customer within 5 business days.

1.5 Any amendment or variation to the agreement must be in writing and signed by both parties. 

1.6 This agreement is governed by and construed in accordance with law in force in the state where the installation of the Goods occurs.

 

2. Obligations

2.1 Quest Energy will supply and install Goods quoted at the address nominated on the quote.

2.2 Quest Energy will ensure that CEC accredited installers and designers are used to design and install the Goods. 

2.3 The Customer will pay the Price to Quest Energy.

2.4 The Customer assigns all of their rights to create all Small Technology Certificates (STC’s) in relation to the Goods to Quest Energy or agents nominated by Quest Energy.

2.5 The price for installation or alteration of the Customer’s meter are set by the Customer’s Energy Retailer and such costs are in addition to the Price and are at the Customer’s sole cost.

 


 3. Quotation

3.1 The quote details the total Price payable by the Customer for Quest Energy for the supply and installation of the Goods.  

3.2 The Customer agrees to pay the deposit amount at the time of signing this agreement. 3.3 The Customer acknowledges that the balance amount is calculated by Quest Energy on the basis of the Customer’s eligibility for government rebates, offers and other discounts as set out in the quote, and that Quest Energy may change these amounts as a result of variations to these rebates, offers or discounts. 

3.4 The Customer agrees to pay the full balance of the Price on or prior to the day of installation. If the Customer fails to pay the balance on the day of installation, Quest Energy is not required to supply and install the Goods to the Customer.

 

 4. Termination

4.1 The Company may terminate this agreement if there are changes to laws relating to the sale, installation, or rebates in respect of the Goods. If this clause is invoked, any monies paid by the Customer will be refunded by Quest Energy. 

4.2 Quest Energy may terminate this agreement if the Customer fails to pay the balance owing on the installation date. If this clause is invoked, any monies paid by the Customer will be retained by Quest Energy.

 

5. Premises Inspection and Other Charges

5.1 For the purpose of calculating the balance amount, Quest Energy will rely on the Customer’s representations in relation to the Customer’s eligibility for the Australian Government’s Solar Credits Scheme.

5.2 The Customer agrees to be present at, or will ensure that a representative of the Customer over the age of 18 years is present at the property during site inspections, installation and or commissioning.

5.3 A call out fee will be charged for any service work provided by Quest Energy that is not a direct consequence of our installation of the Goods.

 

7.           Payment

7.1 All amounts payable to Quest Energy under this agreement can be paid by the following methods: bank cheque, cash, credit card or direct deposit and will be accepted as received when funds clear Quest Energy’s bank account. 

7.2 In the event that the Customer does not pay the full balance owing on or before installation day, the Customer is liable for an amount equivalent to all reasonable fees and expenses incurred by Quest Energy in collecting the outstanding amounts. Amounts include (but not limited to), debt collection fees and legal fees. 

7.3 If the Customer fails to pay all amounts owing by their respective due dates, the Customer must pay Quest Energy interest at a rate of 5% per annum, calculated daily.

 


 

  

8. Delivery and Installation

8.1 The Customer grants Quest Energy and its agent’s permission to enter and remain at the site to conduct site inspections if required, and supply and install the Goods.

8.2 The Customer acknowledges that while Quest Energy and its agents will arrange for the Goods to be connected to the electricity network, the Customer is responsible for arranging connection and installation of electricity at the site with their supplier and this is in no way connected to this agreement. 

8.3 The Customer acknowledges that Quest Energy or its agents are not required to perform maintenance on the Goods installed or supplied unless pursuant to a Warranty claim in clause 9.

 

9.           Warranty

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law. 

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.

9.1 The Customer acknowledges that this is not a warranty document. All Warranties in relation to the Goods are specified in a separate Warranty document supplied by Quest Energy with each system. These documents are available at http://www.questenergy.com.au

9.2 Quest Energy is not liable for inaccuracies in relation to warranties in this document. The Customer should refer to the separate warranty documents for full details. 

9.3 Responsibility will not be accepted by Quest Energy for equipment loss or damage due to any or all of the following: 

9.3.1. Misuse, abuse, neglect or accident. 

9.3.2. Acts of God/natural events – including atmospheric electrical discharges, fire, storm, hail, flooding or water damage howsoever caused.

9.3.3. Power failure, power surge. 

9.3.4. Lack of, or improper maintenance by the Customer. 

9.4 Clause 9.3 does not limit Quest Energy’s liability if Quest Energy or its agents contributed to loss or damage by not installing or connecting the Goods in compliance with applicable laws, regulations and standards. 

9.56. Quest Energy shall not be held liable for any claim in respect of loss of profit, consequential loss of production, or damages incurred or suffered by the Customer relating (whether directly or indirectly) the failure of the Goods.

 

10.                Ownership of Goods and Risk

10.1 Title to the Goods passes to the Customer upon payment in full of the Price and any additional charges, completion of the installation and completion of all documentation required by Quest Energy and receipt by Quest Energy of all Small Technology Certificates in relation to the Goods. 

10.2 In the event that full payment for the system is not provided in accordance with this agreement, the Customer grants permission to Quest Energy or its agents to enter its premises for the purpose of removing the Goods.

 


 

11. Performance of the Goods and Services

 11.1 The Client acknowledges that any representations provided to them by Quest Energy concerning the performance of the Goods and Services is based upon the information provided by the manufacturer and Quest Energy has made no further performance representations.

 11.2 The Client acknowledges that optimal performance of the Goods and Services may be restricted by the required positioning of the Goods and Services but still agrees to Quest Energy installing the Goods and Services even though there is a possibility the performance may not meet the manufacturer’s optimal specifications.

 11.3 The client acknowledges that the solar performance report, solar battery and off grid calculations are indicative only. 

Results provided for the solar system output performance are based on your site specific data. They are provided to give an estimate only and general guide of the potential savings and benefits of installing and using solar panels and batteries. Cost savings may vary depending on such things as variations to usage profiles and other variables which may affect the final commercial results.

 

12. Exclusions and Limitations

12.1 Where additional work is required to be carried out in preparation for installation of the Goods 

(install or modification of meters or work required to ensure compliance with electrical standards), the Customer will be responsible for arranging for this work to take place and will bear the cost of this work.

 

13. Disclaimers

13.1 Representations made to Customers are made in good faith, using information believed to be correct at the time of sale. Quest Energy shall not be responsible for any loss incurred as a result of changes to any government assisted schemes, feed-in-tariffs or other programs. Customers are encouraged to seek their own advice in relation to potential returns associated with their system. 

13.2 Quest Energy is not liable for any claim in respect of loss of profit, consequential loss of production, or damages incurred or suffered by the Customer relating (whether directly or indirectly) the failure of the Goods.
